Construction Contracts for Architects

Read and administer an Indian construction contract from appointment and tender through changes, time, payment, completion and claims. The emphasis is practical: identify who has authority, find the controlling document, issue the required notice, preserve the record and connect each site event to its contractual consequence.

What you will be able to answer

You receive an Indian building contract, its drawings and BOQ, a delayed site-handover record, contractor bills, instructions and correspondence about changed work. What can you produce before the next project meeting?

A contract-administration brief and live register that identify the controlling documents and authorised decision-makers, classify each instruction as original scope or change, track notices and time consequences, reconcile measured work with certified payment, record quality and completion obligations, and state what evidence is still missing. For any emerging claim, the brief separates event, clause, notice, cause-and-effect, time or cost impact without pretending to replace legal advice.

Concept 1

Read the contract as the project's operating system

free

Concept 1 · Read the contract as the project's operating system

0:00 / 0:32

Concept 2

Separate appointments, parties and authority

locked

After: contract-as-project-operating-system

The architect's appointment and the contractor's works contract govern different relationships, so a project title alone never proves authority.

Concept 3

Assemble the contract documents in the right order

locked

After: contract-as-project-operating-system, appointments-parties-and-authority

The same work can be described differently in a drawing, specification and BOQ; the contract decides which document controls.

Concept 4

Recognise the contract type and payment basis

locked

After: contract-as-project-operating-system, contract-documents-and-precedence

The contract type determines whether payment follows measured quantities, a fixed price or a broader design-and-delivery responsibility.

Concept 5

Move from tender to award and commencement

locked

After: appointments-parties-and-authority, contract-documents-and-precedence, contract-types-and-payment-basis

A letter of award creates commitments, but mobilisation should begin only after the agreement, securities, access and commencement conditions align.

Concept 6

Turn a site change into a controlled variation

locked

After: appointments-parties-and-authority, contract-documents-and-precedence, tender-award-and-commencement

A changed drawing or verbal request does not settle who authorised the work, how it will be valued or whether completion time changes.

Concept 7

Administer delay, extension of time and damages

locked

After: appointments-parties-and-authority, contract-documents-and-precedence, tender-award-and-commencement

Delay becomes a contract decision only when cause, notice, programme impact, responsibility and the revised completion date are connected.

Concept 8

Measure, certify and track payment

locked

After: appointments-parties-and-authority, contract-documents-and-precedence, contract-types-and-payment-basis, tender-award-and-commencement

Work becomes payable through evidence, measurement and certification—not merely because a contractor includes it in a bill.

Concept 9

Reach completion and close defects contractually

locked

After: variations-and-change-control, delay-eot-and-liquidated-damages, measurement-certification-and-payment

Physical finishing, certified completion, handover, defect liability and final release are related milestones—not one interchangeable date.

Concept 10

Build a claim from notices and records

locked

After: variations-and-change-control, delay-eot-and-liquidated-damages, measurement-certification-and-payment

A credible claim connects an event to entitlement, notice, evidence and measured effect; a complaint records dissatisfaction but proves none of them.
